The Lusaka High Court has put on hold the Kabushi and Kwacha Parliamentary by-elections, until determination of the matter, in which former law makers, Bowman Lusambo, and Joseph Malanji, are challenging the decision of the Electoral Commission of Zambia, to reject their nominations.
In its ruling, the court says the petitioners would be prejudiced if the matter were heard after the by-elections have taken place.
However, the State has made an application for the matter to be referred to the constitutional court for reference, which will be heard this Thursday.
Meanwhile, the Solicitor General, Marshall Muchende, says that the drafters of the Zambian Constitution did not do a good job, because it has many lacunas.
Mr. Muchende says it is about time that the Zambian Constitution is reviewed, because it is causing confusion, and is not easily understood by ordinary Zambians.
