The High Court in Ndola has dismissed a petition seeking the winding up of Sun Pharmaceuticals Limited after finding that the petitioners lacked the legal standing to bring the action.
The petition had been filed by Zambia Modern Enterprises Limited and two administrators of the estate of the late John C.M. Kalenga under the Corporate Insolvency Act.
In dismissing the matter, High Court Judge S. Chocho ruled that the dispute had already been determined by competent courts and that the court has no jurisdiction to hear the matter.
The court dismissed the petition in its entirety, awarded costs to the affected person and granted the petitioners leave to appeal.
