The State has challenged the jurisdiction of the Lusaka High Court to hear and determine a constitutional bail application by NRPUP presidential candidate Brian Mundubile, his running mate Makebi Zulu and 16 others.
The applicants are facing treason and terrorism-related charges and have been in custody since their arrest on August 14, 2026, a day after Zambia’s General Election.
When the matter came up for hearing of the bail application, Acting Chief State Advocate Chibesa Mulonda raised an objection, arguing that constitutional bail cannot be pursued through a constitutional petition and that the court lacks jurisdiction to hear the application.
The court is expected to deliver its ruling this afternoon.
Meanwhile, Mr Zulu has informed the court that he will represent himself in the matter.
