The Patriotic Front-PF has sued the state and the Electoral Commission of Zambia in the Constitutional Court for setting dates for Kabushi and Kwacha by election despite a pending stay before the courts.
PF Secretary General, Nickson Chilangwa wants to know whether the Electoral Commission of Zambia can go ahead to conduct an election before the final determination of matters in court.
Mr. Chilangwa says the Commission has no power to bar candidates who lost their seats through nullification from contesting a by election as prescribed in the Constitution of Zambia.
Meanwhile, the state says there is no controversy in the decision by two independent aspiring candidates for Kabushi and Kwacha to resign from contesting the by election and later rescind their decision.
The Constitutional Court will hear the matter in Ndola on 13th October 2022.
