PEP TO CHALLENGE RULING BLOCKING LUNGU FROM 2026 ELECTION

The Patriots for Economic Progress (PEP), an opposition political party in Zambia, is gearing up to file a petition before the Constitutional Court to challenge a recent ruling that prevents former President Edgar Lungu from contesting the 2026 general elections. PEP President Sean Tembo has announced that the petition will be submitted on Monday, March 10, 2025, arguing that the court’s decision violates the rights of candidates who participated in the 2021 general elections.

The controversial ruling, which has sparked widespread debate, effectively bars Mr. Lungu from running for office again, citing constitutional limitations on presidential terms. However, PEP contends that the decision is unjust and undermines democratic principles. Mr. Tembo emphasized that the petition seeks to have the judgment reviewed and overturned, ensuring that all eligible candidates, including Mr. Lungu, have the opportunity to participate in the electoral process.

In a statement to Diamond News, Tembo said, “We believe this ruling infringes on the rights of individuals who stood in the 2021 elections. It is our duty to challenge this decision and uphold the democratic values that our nation holds dear.”

Despite PEP’s determination, constitutional lawyer Mehluli Malisa has expressed skepticism about the likelihood of the court’s decision being overturned. Speaking to Diamond News, Malisa stated that the ruling is firmly grounded in the constitution and that there is no legal basis to alter it. “The court’s decision is based on a clear interpretation of the constitution. Unless there is a constitutional amendment, it is unlikely that the ruling will be changed,” he explained.

The impending petition has reignited discussions about Zambia’s constitutional framework and the limitations on presidential terms. Supporters of Mr. Lungu argue that the ruling is politically motivated and aimed at sidelining a prominent opposition figure. On the other hand, proponents of the court’s decision maintain that it is essential to uphold the rule of law and prevent the concentration of power.
