MUKANDILA SEEKS COURT ORDER FOR RELEASE AFTER 14 DAYS IN CUSTODY

Tonse Alliance Secretary General Celestine Mukandila is seeking a court order for his release after spending 14 days in custody without appearing before a court or being granted police bond.

Mr Mukandila was arrested by the Immigration Department at his residence in Mapepe, Chilanga District, on August 20, 2026, and was later charged with unlawful possession of a National Registration Card and failing to disclose that he is a foreigner, charges he denies.

In an affidavit supporting his application for leave to issue a writ of habeas corpus, Mr Mukandila says he provided traceable sureties and repeatedly requested police bond but was told that officers were awaiting further instructions.

He argues that his continued detention is unlawful, violates his constitutional rights, and puts his health and life at risk. He wants the court to direct the respondents to show cause why he should not be released on bond immediately.

He has named the Attorney General as the first respondent and the Immigration Department as the second respondent.
