The Court of appeal is today set to hear the matter in which Bowman Lusambo and Joseph Malanji are challenging the decision of the electoral body to reject their nominations for Kabushi and Kwacha by-elections.

On 16th September, the Court of Appeal stayed judicial review proceedings before the High Court in a matter, pending determination of an application by the State challenging the suspension of the by-elections in Kabushi.

The State and ECZ want the court of Appeal to determine Article 52(4) of the Constitution on how a nomination of a candidate can be challenged and the decision of ECZ returning officer to reject the nomination of the respondents.

The court of Appeal will hear the matter on 22 September 2022.
