Former Lusangazi District Council Chairperson Patrick Banda has petitioned the nominations of the by-election which were held on 13th October 2022 at Lusangazi Civic Centre.

Mr. Banda has cited Electoral Commission of Zambia as the first respondent and Attorney General as the second respondent.

According to the petition filed before the constitution court, the petitioner wants the court to declare the nominations null and void.

Mr. Banda also wants the court to declare that the actions of the attorney general through the agents, Zambia Police, were illegal, unlawful and unconstitutional.

The petitioner wants the court to declare that the actions of the returning officer to reject nominations was illegal and unconstitutional and that fresh nominations should be held for Lusangazi Local Government By-Elections.

The Petitioner through his lawyer Joseph Chirwa of Messrs Ferd Jere and Company alleges that 2nd respondent contravened Articles 47, 52, 153 and 154 of the Constitution of Zambia by preventing the petitioner from filing nomination papers without giving valid reasons.
