The Local Government Elections Tribunal has denied NRPUP Lusaka mayoral candidate Gabriel Kibombwe’s application to testify virtually in his election petition challenging UPND’s Chitambala Mwewa.
The Tribunal ruled that Mr. Kibombwe had not shown sufficient circumstances to justify his failure to appear physically before the court, adding that it was the duty of the parties to bring their witnesses before the Tribunal.
The application was opposed by Mr. Mwewa and the Electoral Commission of Zambia, who argued that the Tribunal rules do not provide for virtual testimony and raised concerns over the court’s ability to properly assess and control such evidence.
Following the ruling, Mr. Kibombwe through his lawyers closed his case, while Mr. Mwewa also through his lawyers closed his case without calling witnesses.
ECZ who is the second respondent in this matter has however, sought an adjournment to prepare one witness, with the Tribunal adjourning the matter to tomorrow, September 22nd, at 10 hours for continued trial.
