Green Party President, Peter Sinkamba and Governance Expert, Isaac Mwanza have sued the Electoral Commission of Zambia for failing to call for fresh nominations following the resignation of aspirant candidates in the Kabushi and Kwacha by-elections.
The petitioners have submitted before the Constitutional Court that ECZ is obliged pursuant to Article 52(6) of the Constitution of Zambia to cancel the by-elections.
They have submitted that the omission by ECZ to do so is in contravention of the constitution, there by illegal.
Mr. Sinkamba and Mr. Mwanza want the court to declare that nominations held by ECZ on 25th August 2022 in Kabushi and Kwacha Constituencies are invalid and any election held in the premise of the said nominations contravenes the constitution.
