
Lusaka lawyer Celestine Mukandila and former Lumezi Member of Parliament Munir Zulu have filed a fresh application seeking to cite the Minister of Justice Princess Kasune, Speaker of the National Assembly Nelly Mutti, her deputies, and all Members of Parliament for contempt over the reintroduction of the Constitutional Amendment Bill Number 7 of 2025.
On December 9, 2025, the Constitutional Court dismissed the petitioners’ earlier application on grounds that it was misconceived, meaning it was based on a wrong understanding of the law and facts and therefore could not be entertained.
In the new application, the petitioners argue that the court’s judgment delivered on June 27, 2025, rendered the Bill unconstitutional, saying it contravened Articles 1(2), 8, 9, 61, 90, 91 and 79 of the Constitution of Zambia (Amendment) Act No. 2 of 2016, among others.
They further contend that the court ordered that the correct procedure be followed and that wide consultation be undertaken but claim that the Speaker and other alleged contemnors have gone ahead to reintroduce Bill 7 in the National Assembly and constituted a committee to review it with the intention of passing it into law.
