The Lusaka High Court has overturned the one-year jail sentence handed to former Presidential aide Amos Chanda for allegedly stealing and destroying court evidence.
In 2024, Lusaka Magistrate Irene Wishimanga convicted Mr. Chanda after ruling that exhibits in a case before the court had gone missing from the judiciary.
Unhappy with the verdict, Mr. Chanda appealed, arguing the lower court erred in law and fact.
Lusaka High Court Judge Situmbeko Chocho has now set aside the conviction, stating that the Magistrate’s Court relied on discredited and contradictory evidence, including data from a tampered device.
The case stemmed from allegations that Mr. Chanda destroyed exhibits related to a matter in which he was jointly charged with Intelligent Mobility Solutions board chair Walid El Nahas and former RTSA CEO Zindaba Soko.
The trio was discharged in 2020 after the then DPP Lilian Siyunyi entered a nolle prosequi.
Mr. Chanda’s alleged confession was captured in an audio recording made at a Lusaka hotel.
