High Court Judge, Charles Kafunda, has ordered for a conclusive medical examination of James Bwalya, one of the suspected abductors of 13 young women in Lusaka.
When the matter came up for presentation of Bwalya’s medical results, the defence presented a back dated report dated 23rd March 2023 which found that the accused was not fit to stand trial.
The State objected to the production of the report because it was done prior to the court order.
In his ruling, Judge Kafunda says the report produced by the defence was casually done as it did not contain details of when the accused will be going for review for proper direction in the matter.
Judge Kafunda has since ordered that the accused undergoes fresh medical examination and the doctor to present his findings before court on 17th April, 2023.
In this matter James Bwalya and Matthew Sikaonga are facing more than 50 counts of rape, Assault, Aggravated Robbery and abducting 13 young women.
