
The trial in the incest case against former Katete District Commissioner Raphael Phiri failed to commence after he applied to the Katete Magistrate Court to engage a lawyer from Lusaka
Mr. Phiri is facing four counts of incest involving his granddaughter, who is below the age of 16, the offense he denies.
When the case came up for the commencement of trial, Mr. Phiri informed the court that he wanted to engage a lawyer to represent him.
Senior State Advocate Nchimunya Munkombwe reluctantly agreed to the application, stating that the accused has been fully aware of the case since August but had failed to engage a lawyer.
Mr. Munkombwe also questioned whether the earlier legal representation from JMP Associates had been withdrawn.
He noted that the delay is costly for the state, especially as some people had travelled from Lusaka and Livingstone for the proceedings.
He urged the accused to put his affairs in order and be ready for the next sitting.
Katete Resident Magistrate Brian Nsofwa granted Mr. Phiri’s request but warned that at the next sitting, the matter will proceed with or without legal representation.
The case has been adjourned to October 21st and 22nd, 2025, for the commencement of trial.
