The Constitutional Court has refused to subpoena the Chief Justice of Zambia, Mumba Malila, the Attorney General, Mulilo Kabesha and State House officials, in a matter involving former Konkola Copper Mines provisional Liquidator Milingo Lungu’s Immunity.

In the petition, Lungu alleges that the Drug Enforcement Commission contravened the law by arresting and prosecuting him when he purportedly enjoys immunity granted by the Director of Public Prosecution.

Lungu alleges that various State Agents were involved in the bargain, led by Principal Private Secretary to the President Bradford Machila, former DPP Lillian Siyunyi, Special Assistant to the President for Legal Affairs Christopher Mundia and Administrator General and Official Receiver, Natasha Kalimukwa.

However, Constitutional Court Judge, Margaret Munalula says there is no relevance for the said officials to testify in the matter as the summons and the affidavit contain nothing more than a list of names.
