The lawyer representing two suspects in the abduction of Pamela Chisumpa and 12 other young women says his client will petition the High Court ruling.
On Wednesday morning, High Court Judge, Charles Kafunda ruled that James Mulenga was fit to stand trial despite expert opinion indicating that the suspect was not fit due to Antisocial Personality Disorder.
In his findings, Justice Kafunda says the accused’s Antisocial Personality Disorder cannot prevent him from answering to his criminal charges because he has no mental illness.
However, the accused’s lawyer Osborne Ngoma says the ruling by the court is against his clients constitutional right to a free and fair trial.
In this matter, James Mulenga and Matthew Sikaonga are facing more than 50 counts of rape, aggravated robbery and assault.
