
The State has argued that once Constitution Amendment Bill No. 7 of 2025 was assented into law on 18 December 2025, no State organ or forum has the authority to challenge or question its validity.
This submission is contained in a matter before the Constitutional Court, where lawyer Makebi Zulu has petitioned the court, seeking a declaration that Constitution Amendment Bill No. 7 (Bill 7) became legally null and void following the judgment in the case of Munir Zulu and Celestine Mukandila v. Attorney General.
In his submissions, Attorney General Mulilo Kabesha stated that upon assent, Bill 7 became law and now forms part of the Constitution of Zambia, in accordance with Article 79(5)(a) of the Constitution.
Mr. Kabesha has urged the Constitutional Court to dismiss the petitioner’s claim that Bill 7 of 2025 was declared invalid and to reject calls for the legislative process to restart afresh without regard to previous decisions.
He further submitted that the procedural concerns raised in the Munir Zulu matter were lawfully addressed through the establishment of a technical committee and the conduct of a consultative process.
The Attorney General argued that the present petition has been overtaken by events, as it seeks to challenge a Bill that has since become law.
He has therefore implored the Court to dismiss the petition with costs, citing an alleged abuse of court process.
