The Opposition Patriotic Front (PF) faction Secretary General, Raphael Nakacinda has filed an application for leave to commence judicial review proceedings against the decision of the Director of Public Prosecution (DPP) to refuse him consent to privately prosecute PF President Miles Sampa and his Secretary General, Morgan Ng’ona.

This is in a matter in which Mr. Nakacinda is challenging the presidency of Mr. Sampa and the election of Mr. Ng’ona as the Party Secretary General.

In an affidavit in support of Ex – Parte summons for leave to commence judicial review proceedings filed at the Lusaka High Court, the applicant seeks among other reliefs a declaration that the said decision of the DPP was null and void.

He also wants an order of certiorari to remove into the High Court and quash the decision of the DPP.

Further, Mr. Nakacinda wants an order of mandamus to oblige the DPP to reconsider his decision in accordance with the law.
