Lawyer Tutwa Ngulube says that the Electoral Commission of Zambia (ECZ) can go ahead and conduct by-elections in Kabushi and Kwacha Constituencies this Friday, but there will be serious constitutional consequences.
Mr. Ngulube says that the Commission will be in contempt of court, if it conducts the by-elections, pending determination of the matters before court.
He adds that stay of execution by the High Court is valid, and that and his clients, Bowman Lusambo and Joseph Malanji, qualify to contest.
On Monday, October 17th, 2022, the Constitutional Court ruled that the ECZ did not breach the constitution when it did not call for fresh nominations, and that the nominations filed on August 25th of this year are valid.
Meanwhile, preparations for Friday’s by-election have begun in Kabushi and Kwacha Constituencies, and officers have been positioned at polling stations.
