The Constitutional Court has dismissed an application by the state to halt judgement in a matter it is supposed to rule whether or not the Electoral Commission of Zambia (ECZ) holds the suspended Kabushi and Kwacha by-elections within 90 days as prescribed by law.
This follows an application by the state urging the court to halt its judgment which was initially scheduled for Monday this week until the matter is heard conclusively.
The duo petitioned the Electoral Commission of Zambia (ECZ) before the Constitutional Court over the alleged failure to call for fresh nominations despite two aspiring candidates for Kabushi and Kwacha constituencies resigning from the race.
They are seeking a declaration that the nominations and elections that would be held in Kabushi and Kwacha constituencies after October 27, 2022 and November 2, 2022, respectively.
