
The Lusaka High Court has dismissed the main matter filed by PF faction Secretary General Morgan Ngona against matero MP Miles Sampa, seeking to stay the decision to expell him as SG.
The court has attributed it’s ruling to lack of prosecution after the matter remained unresolved for an extended period.
In a ruling delivered by Judge Conceptor Zulu, the court dismissed the entire application brought by Ngona for want of prosecution.
Mr Ngona was challenging the decision by Miles Sampa, in his capacity as President of the Patriotic Front to remove him from the position of Secretary General and an order that Mr Sampa’s decision to dissolve the Central Committee was illegal as he did not weild such powers.
However Mr Ngona has since appealed the ruling of the high court stating that the court arred in law and fact when it dismissed the matter citing several interlocutory applications made.
He further contended that the judge misdirected herself when she dismissed the matter for want of prosecution on an application made by Mr Sampa without making findings on whether his delay in prosecution would give rise to substantial risk that is capable of endangering a fair trial.
